Our General Terms and Conditions
The following General Terms and Conditions of Travel are agreed upon between the customer (traveler) and the tour operator Talizi Safaris.
1. Conclusion of the Travel Contract / The Booking
1.1
The basis of this offer is the travel advertisement from Talizi Safaris, which we have prepared and transmitted to you based on our individual agreements, with the help of our website and other media from Talizi Safaris.
By submitting the travel application (the booking) the traveler offers Talizi Safaris the conclusion of the travel contract.
1.2
The contract is concluded upon issuance of the travel confirmation (declaration of acceptance) by Talizi Safaris. Talizi Safaris will send the traveler a travel confirmation as a pdf file immediately after or shortly after the conclusion of the contract. If the contract is concluded with simultaneous physical presence, the traveler is entitled to receive a travel confirmation in paper form.
1.3
If the content of the travel confirmation differs from the travel registration, this travel confirmation is considered a new offer to which Talizi Safaris is bound for a period of ten days. The contract is concluded on the basis of this new offer, provided that Talizi Safaris has pointed out the change and has fulfilled its pre-contractual information obligations in this regard and the traveler declares the acceptance of the offer to Talizi Safaris within the binding period explicitly or conclusively by paying the travel price.
1.4
Bookings and the resulting contract become legally valid in Windhoek, Namibia. Therefore, the contractual regulations and laws of the Republic of Namibia apply.
• The place of jurisdiction is Windhoek, Namibia.
• Talizi Safaris reserves the right to refuse bookings in absolute exceptional cases without giving reasons.
2. Deposit & Payment
2.1
After conclusion of the contract, a deposit in the amount of 30% of the travel price is due. Only after receipt of payment will the booking be considered confirmed. If the total amount invoiced is not paid within 4 weeks before the start of the trip, Talizi Safaris reserves the right to cancel the trip and retain the deposit. Bookings made within the period of 4 weeks must be paid in full immediately after booking. The booking will only be considered confirmed after receipt of the full payment.
2.2
All bank charges incurred on payment must be borne by the customer. This also includes the fees charged by our bank and our bank. The total amount specified on the invoice must reflect on our bank account. Any unpaid differences will be invoiced and must be paid before the start of the trip.
3. Booking Amendments
3.1
For changes to existing bookings made by customers (e.g. changes to travel dates, rebooked flight tickets, changes to accommodations, changed number of participants, etc.), a rebooking fee of N$ 750.00 will be charged as compensation for expenses and administration. The rebooking fee is in addition to any costs that may be incurred by other service providers.
4. Cancellations
4.1
Cancellations must be submitted in writing to the person who confirmed the booking. Cancellations will only take effect at the moment of receipt in writing. In the event of a cancellation, Talizi Safaris reserves the right to retain the deposit as a cancellation fee.
4.2
If a confirmed booking is cancelled, the company is entitled to charge the following cancellation fee as fallows:
– up to 4 weeks before the start of the trip – 30% cancellation fee
– 4 – 2 weeks before the start of the trip – 50% cancellation fee
– 2 – 1 weeks before the start of the trip – 80% cancellation fee
– Less than 1 week before the start of the trip – 90% cancellation fee
4.3
Talizi Safaris reserves the right to cancel a trip at its discretion and unilaterally without further warning for special reasons in absolutely exceptional cases (natural disasters, safety concerns, etc.) In such a case, Talizi Safaris is willing to refund payments made immediately. This is Talizi Safaris` sole responsibility in such a case. Therefore, Talizi Safaris accepts no liability for lost holiday enjoyment, incurred losses or costs, any claims, or expenses arising from such a cancellation.
5. Passport, Visas and others Travel Papers
5.1
It is the customer’s own responsibility to ensure that passports, visas, required vaccinations & vaccination certificates, and other travel documents comply with the guidelines of the countries to be visited and are valid.
5.2
Talizi Safaris bears no responsibility for the consequences, damages, or claims arising from the customer’s failure to comply with regulations, rules, and travel requirements and to arrange the necessary travel documents before the start of the trip.
6. Insurance
6.1
It is a condition of booking and the sole responsibility of travellers to ensure that they carry adequate comprehensive travel and medical insurance to cover themselves and any dependents/travelling companions for the duration of their trip.
6.2
This insurance should include cover in respect of, but not limited to, the following eventualities: cancellations or curtailments of bookings, weather disruptions, emergency medical evacuation expenses, medical expenses, repatriation expenses, damage/theft/loss of personal baggage, money and goods. Travellers will be charged directly by the relevant service providers for any emergency services they may require and may find themselves unable to access such services should they not be covered by the relevant insurance policy.
6.3
If you opt to use travel insurance as offered by credit card companies please check their inclusions and exclusions very carefully to ensure that you and all party members are adequately covered for all eventualities as indicated above.
6.4
Talizi Safaris including their representatives, employees and agents will not be liable for lack of travel insurance taken out by the client in terms of national law or international law, or in the case of the client not taking out travel insurance in the case where there is no legal requirements demanding travel insurance in the destination country.
7. Baggage
7.1
At no time is Talizi Safaris responsible for the luggage or personal belongings of the customers. Therefore, Talizi Safaris cannot be held responsible for loss or damage to baggage/personal effects.
7.2
Talizi Safaris assumes no liability for damages or loss of personal belongings.
Please note that separate baggage regulations may apply to trekking tours and the use of small aircraft (so-called bush flights). These will be communicated during the offer preparation.
8. Risk
8.1
The customer accepts that all tours and activities booked with Talizi Safaris have an adventurous nature and involve a certain personal risk. Neither Talizi Safaris nor its service providers or sub-booking agents can be held responsible for injuries of any kind, death of the traveler, or damage to property, regardless of the cause. The customer assumes full responsibility for all potential risks that may occur during this type of travel.
8.2
The customer indemnifies Talizi Safaris and holds Talizi Safaris harmless against any claims arising out of damage to or loss of property, bodily injury or death or any other kind of loss or damages or cause of action. This indemnification shall be binding on the customer’s heirs, spouses, executors and successors in title.
9. Authorities on our Tours
9.1
Decisions made by managers, drivers, and guides of Talizi Safaris that are communicated to the customer are final and binding.
9.2
The customer must adhere to the regulations, rules, and laws of the countries visited at all times during the tour.
10. Marketing
Talizi Safaris reserves the right to use all photos and videos taken by its staff on a tour for marketing or advertising purposes. The customer hereby agrees that the company will have copyright in such cases and that the company may use photos and videos which include the customer.
11. Force Majeure
Talizi Safaris is not liable for events attributable to force majeure. These include, for example, but are not limited to: war, technical/mechanical breakdowns, bad weather, emerging riots, and other unforeseeable events beyond the company’s control that lead to delays or necessary changes to the travel itinerary or to cancellations. Furthermore, in cases of force majeure, Talizi Safaris cannot be held liable for deviations from the planned travel itinerary.
12. Price changes
All our offers are subject to the current national park fees and taxes. If the national park authorities or other government authorities decide to increase fees or taxes in an unforeseeable manner, we will have to pass on these increases immediately.
